The terms ‘HealthyWay’, ‘us’, ‘our’, or ‘we’ refer to HealthyWay Cleaning Pty Ltd, the owner of the website. The terms ‘you’ or ‘your’ refer to the user or viewer of this website.
Your use of this website is subject to the following terms and conditions, which may change without notice.
DEFINITIONS AND INTERPRETATION
- Customer: A registered user of the HealthyWay website who can book a cleaning service (“Job”).
- Equipment and Materials: Cleaning products and tools (e.g., vacuums, mops, etc.) necessary to complete a Job.
- Job: Any domestic or commercial cleaning service booked by a Customer on the HealthyWay website or through communication with HealthyWay staff.
- Job Fee: The amount paid by the Customer for a Job, as published on the HealthyWay website or agreed upon between the Customer and HealthyWay.
- Job Request: A request for a Job made by a Customer via the HealthyWay website.
- Location: The address where the Job will be performed.
- Service Provider: A party who undertakes cleaning Jobs for Customers and has a Service Agreement with HealthyWay.
- Service Agreement: An agreement between HealthyWay and a Service Provider, outlining the terms under which the Service Provider offers cleaning services to Customers.
- User: Any Customer or Service Provider that uses the HealthyWay website.
USING THE WEBSITE
General
- To use the HealthyWay website, you must register and create an account.
- By using the HealthyWay website, you agree to these terms and conditions.
- When a Service Provider accepts a Job, a separate agreement is formed between the Customer and the Service Provider, with terms outlined in this agreement.
- Customers over 18 may request and book Jobs in service areas covered by HealthyWay.
- Only Service Providers with a valid Service Agreement with HealthyWay can undertake Jobs.
- The Customer acknowledges that HealthyWay does not directly provide the cleaning services; rather, the Service Provider performs the Job.
Features
Customers can:
- Request and book cleaning Jobs.
- Make payments to HealthyWay.
- Rate Service Providers and leave feedback on Jobs.
- Manage their HealthyWay account.
Service Providers can:
- Receive, accept, or reject Customer requests for Jobs.
- Manage Jobs, log completed work, and process payments.
- Manage their HealthyWay account.
BOOKING A JOB
- To book a Job, the Customer must submit a Job Request through the HealthyWay website.
- HealthyWay will confirm the Job Request within 24 hours, but it cannot guarantee that a Service Provider will accept any specific request.
- Once confirmed, the Service Provider agrees to perform the Job to professional standards at the Customer’s Location.
PERFORMING THE JOB
- The Service Provider agrees to arrive at the specified Location on time and perform the Job to a professional standard.
- The Customer must ensure that the work environment is safe, including restraining pets, providing access to electricity and water, and ensuring no hazards are present.
- The Customer acknowledges that minor wear and tear may occur during a Job. The Service Provider is not liable for accidental damage valued under $100 unless due to negligence.
CANCELLATIONS AND RESCHEDULING
- The Customer may cancel or reschedule a booking at no charge up to 24 hours before the scheduled Job.
- Cancellations made within 24 hours will incur a cancellation fee of $70.
- If the Service Provider arrives at the Job and is unable to perform the service due to Customer actions (e.g., no access, utilities not available), a call-out fee of $120 will apply.
- HealthyWay will attempt to find a replacement Service Provider if the original one cannot attend, but it cannot guarantee the availability of a replacement.
PAYMENTS AND REFUNDS
- The Customer agrees to pay the Job Fee, which will be charged to the Customer’s credit card after the Job is completed.
- HealthyWay may issue invoices in special circumstances (e.g., corporate or NDIS services), which must be paid within 15 days of the Job completion.
- Late payments over 30 days will incur an additional 10% fee, and failure to pay within 90 days will result in the account being sent to a debt collector, with the Customer responsible for associated fees.
- Customers agree not to make payments directly to the Service Provider. Any direct payment will void all guarantees, and HealthyWay will not be liable for the Job.
- Refunds or credits may be issued at HealthyWay’s discretion if the Job is not performed or completed satisfactorily. Refunds will not be issued in any other circumstances unless required by law.
